TERMS AND CONDITIONS

1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your use of the website located at   https://www.whytemechanical.ca (the "Site") and the services provided by Whyte Mechanical Ltd.   ("Whyte Mechanical," "we," "us," or "our"), a company registered in British Columbia, Canada, with its principal place of business at 1625 Ingleton Ave, Burnaby, BC, V5C 4L8.

By accessing our Site, submitting a booking or contact form, or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our Site or services.

2. Services

Whyte Mechanical provides residential and commercial mechanical contracting services, including   but not limited to HVAC installation, repair, and maintenance; plumbing services; and related   mechanical work. The availability, scope, and pricing of specific services are subject to change   without notice.

All service work is subject to a separate service agreement or work order executed between Whyte   Mechanical and the customer prior to or at the commencement of work. In the event of any conflict   between these Terms and a signed service agreement, the signed service agreement shall prevail.

3. Appointments and Booking

Appointment requests submitted through our website, by phone, or via text message are subject to   availability and confirmation by Whyte Mechanical. Submission of a booking request does not   constitute a confirmed appointment until you receive written or verbal confirmation from us.

We reserve the right to reschedule or cancel appointments due to technician availability, weather,   safety conditions, or other circumstances. We will make reasonable efforts to provide advance   notice of any changes.

4. SMS, Text Message, and Communications Consent

4.1 Consent to Receive SMS Messages
By providing your mobile phone number on our booking form, contact form, or any other consentcollection point on our Site and checking the SMS opt-in checkbox, you expressly consent to receive text messages from Whyte Mechanical Ltd. at the number provided. Consent to receive SMS   messages is not required as a condition of purchasing any service.  

4.2 Types of Messages  
Text messages we send may include:  
• Appointment confirmations and reminders  
• Follow-up messages regarding your service or equipment  
• Responses to inquiries submitted via our online forms  
• Promotional messages about our services, seasonal maintenance programs, and special offers  

4.3 Message Frequency
Message frequency will vary based on your account status:  
• New customers and active leads: up to 3–4 messages per month  
• Existing customers: approximately 3–4 messages per year

4.4 Opt-Out
You may opt out of receiving text messages at any time by replying STOP to any message from us.   Following your opt-out, you will receive one final confirmation message, and no further   promotional or automated messages will be sent to that number. To resume receiving messages,   reply START or contact us directly.  

4.5 Automated and AI-Assisted Communications

Some of our communications, including inbound call responses and outbound messages, may be   handled or assisted by automated systems or artificial intelligence platforms. By engaging with our   services, you acknowledge and consent to the possibility of receiving automated or AI-assisted   communications in connection with your service requests and appointments.

5. Payment Terms

Payment for services is due upon completion of work, unless otherwise agreed in writing. We   accept payment by the methods indicated on your service invoice. Online payments are processed   securely through our field service management platform; we do not retain full payment card   information.  

Whyte Mechanical reserves the right to charge for diagnostic or assessment visits as disclosed prior   to the appointment. Estimates provided are subject to change based on actual site conditions   identified during the work.

6. Warranties and Service Disclaimers

Whyte Mechanical warrants that all services will be performed in a workmanlike manner by   qualified technicians in accordance with applicable British Columbia codes and standards. Specific   warranty terms for parts, equipment, and labour will be outlined in the applicable work order or   service agreement.

THE SITE AND ANY INFORMATION PROVIDED ON IT ARE OFFERED "AS IS" AND "AS AVAILABLE"   WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE   SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL   COMPONENTS.

Nothing on our website constitutes professional engineering, design, or code compliance advice.   Customers should obtain appropriate professional guidance for complex mechanical or structural   decisions.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHYTE MECHANICAL LTD. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT,   INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH   DAMAGES.

In no event shall Whyte Mechanical's total liability to you for any claim arising from or related to a specific service engagement exceed the amount paid by you to Whyte Mechanical for that specific service.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages;  in such jurisdictions, our liability is limited to the extent permitted by law.

8. Intellectual Property

All content on the Whyte Mechanical website, including text, graphics, logos, images, and software, is the property of Whyte Mechanical Ltd. or its content suppliers and is protected by applicable Canadian copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.

Our Site may contain links to third-party websites or reference third-party services. These links are provided for your convenience only. Whyte Mechanical does not endorse, control, or assume any responsibility for the content or practices of any third-party websites.
